Copyright Notice
The Government of the Hong Kong Special Administrative Region (“HKSARG”) owns the copyright of this document (“Competition Document”) including Annexes A and B. Unless prior written authorisation from the HKSARG is obtained, any printing, reproduction, adaptation, distribution, dissemination, making available to the public or other uses of any copyright works contained in this Competition Document is strictly prohibited. Registered competition participants may print, reproduce and use the content of the Competition Document for the purpose of making submissions for the Competition.

For the purpose of this Competition Document: “Participant” means a Participant of the Competition, “Entry” means all deliverables submitted by a Participant.

Confidentiality of Entries
The Participant shall keep his/her Entry confidential and ensure the same is not disclosed to any third party throughout the Competition until the announcement of the Competition results.

Duplicate Copy of Entries
The Organiser and the Judging Panel will employ all possible preventive measures to ensure that all Entries are treated with proper care. However, the Organiser and the Judging Panel will not be responsible for any damage or loss of the Entries.

Participants are advised to retain a duplicate copy of their Entries in case of any unforeseeable events that may lead to loss or damage of the Entries. Under such circumstances, the Participants will be requested to forward the duplicate copy of their Entries to the Organiser at no costs to the Organiser and/or the Judging Panel.

Intellectual Property Rights
The Participant declares and confirms that the Participant is the sole owner of all copyrights of the submitted Entries and no complaint or claim shall be arisen from any third party in respect of such Entries.

The Participant declares and confirms that the Entries (including the photos or picture, the name and elaboration) are original work taken by the Participant.

The Participant declares and confirms that the Entries do not:

If an Entry submitted by the Participant infringes or violates any third party’s rights, including but not limited to intellectual property rights, and/or any legislation, law or regulation, the Organiser shall not be responsible for any consequences, legal or otherwise, thereto.

The Organiser at all times reserves the full right to disqualify Entries that in the sole opinion of the Organiser infringe the intellectual property rights of others.

The Participants shall bear full legal and related responsibilities arising from any possible breach of intellectual property rights in respect of their entries, and shall indemnify the Organiser and other concerned parties against any claims and liabilities arising from any such breach.

Exhibition and Publication of Entries
By submitting an Entry for the Competition, Participants are deemed to give an irrevocable perpetual license to the Organiser to use, edit, modify or copy the submitted Entry for any purposes, including but not limited to publish, print, exhibit, display, promote, issue or any other purposes as the Organiser considers appropriate, whether in Hong Kong or other places, in public and/or by means of publication and printings, web pages, electronics and other means, without prior consent of the Participants or payment any royalty / remuneration to the Participants.

If the Participant’s Entry gets an award in this Competition, they shall warrant and guarantee that they had not, have not and/or will not give the above license to any third party. In consideration of the prizes obtained in this Competition, the Participants shall further agree to assign the ownership of intellectual property right of the Entry to the Organiser.

Participants shall agree to accept the invitation to promotion activities related to the Competition by the Organiser.

Personal Information Collection
The Participant shall complete the Entry Form. The personal information provided in the Entry Form will be used for the following purposes:

  1. registration of Entries and verification of the eligibility of the Participant;
  2. correspondence with the Participant;
  3. announcement of the results of the Competition and award of the prizes relating to the Competition;
  4. identification of the Participant in publishing, printing, exhibition and promotion of the Entries;
  5. enforcement of provisions of the License;
  6. other purposes related to the Competition; and
  7. purposes related to the purposes referred to in sub-paragraphs (i) to (v) above.

The personal data provided in the Entry Form may be disclosed to the Organiser, other Government departments and bureaux, professional institutes and the public for purposes mentioned in the above.

The Participants have a right to request access to and correction of your personal data provided in your Entry in accordance with the Personal Data (Privacy) Ordinance (Cap.486). Should you need to exercise the right, you should make your request in writing to the Organiser.

Remuneration
Apart from the prizes awarded to the winners, all Participants shall not be entitled to any remuneration, payment or compensation for participating in the Competition.

Language and Time
The Entry Form and the written descriptions of the Entry shall be completed in English or Chinese.

Throughout the course of the Competition, time mentioned in the Competition Document shall be Hong Kong time.

Compliance
Any Participant who does not abide by the rules, requirements or conditions as set out in this Competition Document may result in disqualification from the Competition. Any disqualification shall be at the absolute discretion of the Organiser. The decisions of the Organiser shall be final and binding on all parties concerned, and shall not be disputed or appealed. Such decisions, the reasons and details will not be disclosed.

Disclaimers
The Organiser and the Judging Panel shall not be responsible or liable for any erroneous, damaged, destroyed, lost, late, incomplete, illegible and misdirected Entries, or any damage or loss arising from, connected with, or relating to the Competition, the submission of Entries to the Competition, participation in the Competition, regardless of the act, omission, negligence, cause or any fault by the Organiser and/or the Judging Panel, and notwithstanding that any of those persons may have been advised of the possibility such loss or damage being incurred.

#The Organiser may at its discretion cancel, modify or suspend the Competition. Participants shall not be entitled to any compensation as a consequence of such cancellation, modification or suspension of the Competition.

Jurisdiction
The Organiser’s decision regarding all aspects of the Competition is final and binding on all parties concerned.

This Competition Document shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. The Organiser and the Participants shall submit to the non-exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.

Severability
If any provision herein is determined to be illegal or unenforceable by any court of competent jurisdiction or arbitrator, such provision shall be deemed to have been deleted without affecting the remaining provisions of the Competition.

General Provisions
Upon submitting the Entries, the Participants are deemed to have accepted the rules and regulations of the Competition. #The rules and regulations of the Competition may be subject to change without prior announcement by the Organiser.
